Lakeland Regional Medical Center, Inc. (LRMC), petitions this court for a writ of certiorari to review the non-final order denying its motion to dismiss. The motion claimed that Lona Q. Allen, as Personal Representative of the Estate of Henry F. Allen, deceased (Allen), failed to comply with the presuit notice requirement of chapter 766, Florida Statutes (2004). We deny the petition because the trial court correctly ruled that Allens complaint only sounded in simple negligence and, hence, the presuit notice requirement of chapter 766 does not apply.
